Commercial electronic message consent and explicit consent text

This English translation is provided for convenience. The Turkish text is the governing version.

What this text is for

This is the full text of the consent you give for announcement and event emails about IWB. When you check the marketing box on the demo and quote request forms, you make the statement set out in this text.

Checking the box gives both of the following:

• consent to commercial electronic messages under Article 6 of Law No. 6563 on the Regulation of Electronic Commerce (ETK), and
• explicit consent, under Article 5(1) of Law No. 6698 on the Protection of Personal Data (KVKK), to the processing of your data for this purpose.

There is a single, specific subject: marketing by email. For this reason, both consents are obtained through a single statement. For marketing emails, we do not rely on any legal basis other than your explicit consent.

This text is not a privacy notice. How the data you provide in the request forms is processed is explained in the KVKK Privacy Notice: website and request forms; that notice does not ask for your consent.

The ETK allows commercial messages to be sent to merchants and tradespeople without their prior consent. We do not use this exception: we do not send marketing messages to merchants and tradespeople without their consent either.

The following do not depend on this consent; you will receive them even if you do not give consent:

• Our response to your demo or quote request: scheduling the meeting, the quote, and answers to your questions.
• Usage, maintenance, release, and security notices about the service you receive, if you are our customer (ETK Article 6(1)).

Scope of the consent

In this text, Firmanet refers to itself as “we.”

Each of our emails includes Firmanet’s trade name and contact details as the sender, the purpose of the email (announcement, promotional campaign, or event), and a link to withdraw your consent.

We do not rely on this consent to use your data for any other purpose or to share it for the marketing of other companies.

Consent and explicit consent statement

The checkbox text is the same on the demo and quote request forms:

Firmanet’in IWB ürün, kampanya ve etkinlik duyurularını e-postayla göndermesine onay veriyor, bu amaçla ad soyad, e-posta ve firma bilgilerimin işlenmesine açık rıza veriyorum.

English translation of the statement, for information only:

I consent to Firmanet sending me announcements about IWB products, promotional campaigns, and events by email, and I give my explicit consent to the processing of my full name, email, and company information for this purpose.

The following information also appears below the checkbox. On the demo form: “Consent is not a condition of your demo request. You can withdraw it at any time.” On the quote request form: “Consent is not a condition of your quote request. You can withdraw it at any time.”

The “Marketing email consent” link below the checkbox opens this page. In the statement, product announcements also cover new features, and event announcements also cover webinars.

We ask for your consent only through this checkbox. We do not send you commercial messages to ask for consent.

Consent is not a condition

• The checkbox is unchecked by default; checking it is entirely your choice.
• Even if you do not give consent, your demo or quote request is reviewed in the same way, and we will get back to you.
• Consent is not a condition of any of our products or services.
• The checkbox is only for email marketing; consent for any other purpose or channel is not obtained through this checkbox.

Withdrawing consent

You can withdraw your consent at any time, without giving a reason and free of charge:

• using the withdrawal link in each of our marketing emails, or by replying to the email;
• by writing to [email protected];
• through the Message Management System (İYS), at iys.org.tr.

We give effect to your withdrawal request no later than 3 business days after it reaches us, and we notify İYS of it. After that period, we do not send you marketing emails.

Withdrawal takes effect for the future; messages sent up to that point remain valid. Withdrawal does not affect your request, your quote process, or, if you are our customer, service notices.

Record of consent

To be able to prove your consent, we record:

• the time the consent was given;
• the version of the consent text (the version label at the top of this page);
• the form through which the consent was obtained (the demo or quote request form);
• the full name, email address, and company name you provided with your consent.

We register your consent with İYS within 3 business days of receiving it. Within 24 hours, we send a notice to your email address confirming that the consent you gave electronically has been received.

After you withdraw consent, we keep the consent record only to prove the consent and its withdrawal, as required by our legal obligation (KVKK Article 5(2)(ç)). We do not use this record to send you messages. We destroy records whose retention period has expired; details are in the Personal Data Retention and Destruction Policy.

Related privacy notice

The purposes for which the information you provide in the request forms is processed, the parties to whom it is transferred, transfers abroad, and retention periods are explained in the KVKK Privacy Notice: website and request forms. This explicit consent is only for email marketing; it is not the basis for transferring your data abroad.

Changes

A change that broadens the scope of the consent (for example, a new channel or a new type of content) will not apply to you without your new consent. The original language of this text is Turkish; any version in another language is for information only.

The version and the update date are shown at the top of the page. When we change this text, we publish the new version at this address; the change applies from the date it is published.
